Dear Chairperson and Committee Members,
I am an Indian citizen and I am submitting my inputs and suggestions on the “WAQF (Amendment) Bill 2024” to this committee.
India is a “Secular” “Democratic” nation. These two prominent characteristics of India are categorically declared in the Constitution of India. These two characteristics of the nation has implications on the government and laws of the nation.
- A nation is secular only when all the laws of the nation are equal and there are no separate set of laws based on religion. Religion is a personal matter of individuals and the state or the government or the laws of a secular nation cannot treat people differently based on the religion of the individual.
- Democracy is a people oriented system of governance. Democracy is neither a majority driven governance system nor minority driven governance system. In a democratic system of governance, rights of any group of people or individual cannot be allowed to subdue or cancel the rights of others. Therefore the government is duty bound to ensure equal rights are granted to every individual regardless of the group or the religion they belong to.
WAQF Act governing and the WAQF Board constitute gross violation of the Constitution of India because WAQF Act is religion based. It subdues the rights of the citizens belonging to other groups or religion. Therefore the WAQF Act is against the fundamental principles of Secularism and Democracy.
The argument that WAQF Act exist to protect the interests of the members of religious minorities of India is completely flawed argument. Protecting interests of members of a religious minority does not give right to the government to enact laws to harm the interests of members of other religions or of other groups.
Laws discriminating people based on their religion are darkest blot and crime committed on nation.
I therefore submit my recommendation as a citizen of India to scrap the WAQF Act and abolish WAQF Board in totality. I also recommend that the properties held by WAQF Board or the members of WAQF Board to be returned to the rightful owners, or their legal heirs, from whom WAQF Board has taken over the ownership of the property.
I appreciate the you for considering my inputs and recommendations for scrapping of WAQF Act and abolishing of WAQF board to ensure the best interests of India and all Indian citizens.
